Terms of Service

Welcome to CrossTalk. By using our Discord translation bot and web dashboard ("Service"), you agree to these Terms of Service ("Terms"). Please read them carefully.

1. Acceptable Use

1.1 Permitted Use

You may use CrossTalk to facilitate multilingual communication in Discord servers where you have appropriate permissions. The Service is intended for legitimate translation purposes only.

1.2 Prohibited Activities

You agree NOT to:

• Use the Service to translate illegal, harmful, or abusive content
• Attempt to reverse engineer, decompile, or hack the Service
• Use the Service to spam, harass, or violate Discord's Terms of Service
• Resell, redistribute, or sublicense access to the Service
• Use automated tools to abuse API rate limits or quotas
• Impersonate others or misrepresent your affiliation with any entity

1.3 Content Responsibility

You are solely responsible for the content you translate using CrossTalk. We do not monitor, review, or control user-generated content. You agree to comply with all applicable laws and Discord's Community Guidelines.

2. Subscription Terms

2.1 License Tiers

CrossTalk offers three license tiers: Free, Pro, and Premium. Each tier has different features and usage limits as described on our pricing page. We reserve the right to modify tier features and pricing with 30 days notice.

2.2 Payment

Pro and Premium subscriptions are billed monthly or annually in advance. All fees are non-refundable except as required by law. You authorize us to charge your payment method for all fees incurred.

2.3 Usage Limits

Each tier has daily character translation limits. If you exceed your limit, translation services will be suspended until the next daily reset or until you upgrade your tier. We may implement additional rate limits to ensure fair usage.

2.4 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until that date. No refunds will be provided for partial billing periods.

2.5 Downgrades

If you downgrade from a paid tier to Free, you will lose access to premium features immediately. Any translation routes or configurations that exceed Free tier limits will be disabled.

3. Data Retention

3.1 Configuration Data

We store your translation route configurations, guild settings, and usage statistics for as long as you use the Service. This data is necessary to provide the Service.

3.2 Message Data

CrossTalk does not permanently store message content. Messages are processed in real-time for translation and then discarded. We may temporarily cache message relationships for deletion synchronization (up to 30 days).

3.3 Account Deletion

If you remove the bot from all your servers or delete your Discord account, we will delete your configuration data within 90 days. You may request immediate deletion by contacting support.

3.4 Backup and Recovery

We maintain backups of configuration data for disaster recovery purposes. Backups are retained for up to 30 days and are securely deleted thereafter.

4. Termination

4.1 Termination by You

You may terminate your use of the Service at any time by removing the bot from your Discord servers and canceling any paid subscriptions.

4.2 Termination by Us

We reserve the right to suspend or terminate your access to the Service at any time for violations of these Terms, abusive behavior, or any other reason at our sole discretion. We will provide notice when reasonably possible.

4.3 Effect of Termination

Upon termination, your right to use the Service immediately ceases. We will delete your configuration data in accordance with our data retention policy. Paid subscriptions are non-refundable upon termination.

5. Disclaimers and Limitations

5.1 Service Availability

The Service is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue the Service at any time.

5.2 Translation Accuracy

While we use high-quality translation services, we do not guarantee the accuracy, completeness, or appropriateness of translations. Automated translation may contain errors or misinterpretations.

5.3 Limitation of Liability

To the maximum extent permitted by law, CrossTalk and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

5.4 Third-Party Services

The Service integrates with Discord and third-party translation APIs. We are not responsible for the availability, accuracy, or policies of these third-party services.

6. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting a notice on our website or sending an email to your registered address. Continued use of the Service after changes constitutes acceptance of the new Terms.
